Washington Consumer Health Privacy Policy

This Washington Consumer Health Data Policy supplements the Livtality Privacy Notice and only applies to personal information that is “consumer health data” under the Washington State My Health My Data Act. It applies only if you are:

• A resident of Washington; or
• An individual about whom information is collected in Washington.

“Consumer Health Data” is personal information that is linked or reasonably linkable to you and that identifies your past, present or future physical or mental health status, unless an exception applies. For example, it does not apply to data that is “Protected Health Information” under the Health Insurance Portability and Accountability Act (“HIPAA”), which provides you other rights.

Collection

As described further in the “Personal Data We Collect” section of the Livtality Privacy Notice, the categories of consumer health data we collect include:

• Reproductive or sexual health information;
• Information that could identify your attempt to seek health care services or information, such as Device Identifiers and Online Identifiers essential to running our website such as Internet Protocol (IP) address, Media Access Control (MAC) address, operating system and version, and Internet browser type and version;
• Other information that may be used to infer or derive data related to the above or other health information;

As described further in the “Personal Data We Collect” section of the Livtality Privacy Notice, we collect consumer health data from you when you input it into the Services, such as when you search for or purchase supplements associated with particular medical conditions (e.g., pre-natal vitamins, weight-loss, sexual dysfunction, etc.).

Use

As described further in the “How We Use Your Personal Data” Section of the Livtality Privacy Notice, we primarily use consumer health data as reasonably necessary to provide you with the products you have requested or authorized. 

We may use it for the following purposes: 

• To provide you with information about the supplements requested by you,
• Ensuring the secure and reliable operation of our systems and systems that support them, including troubleshooting and improving the services,
• Essential business operations that support the provision of the services such as analyzing our performance, meeting our legal obligations, developing our workforce, and conducting research and development, and  
• Other purposes for which we give you choices or obtain your consent as required by law – for example, for advertising or marketing purposes. 

Disclosure

We may share each of the categories of consumer health data described above for the purposes described in “Disclosing Your Personal Data?” section of the Livtality Privacy Notice.

Consumer Rights

You may have rights with respect to your consumer health data, including rights to access, delete, or receive a list of third parties and affiliates with whom your consumer health data was shared or sold (with authorization). You also may have the right, subject to certain exceptions, to withdraw consent relating to the use, sharing, or selling (with authorization) of your Washington consumer health data. We call these and other rights you may be given by the Livtality Privacy Notice your “State Privacy Rights.”

You also have the right to appeal a decision we make concerning your consumer rights.

You can request to exercise your consumer rights, including the right to appeal, by contacting us, as outlined in the “Contact Us” section of the Livtality Privacy Notice.
